General Ticket and Event Terms and Conditions of the
pro-log GmbH

The present General Ticket and Event Terms and Conditions shall apply exclusively to visits to the ABENTEUER & ALLRAD trade fair and to lectures and special events held there by pro-log. These General Ticket and Event Terms and Conditions shall be accepted and observed by the customer and any person represented by the customer (hereinafter also referred to as "visitor" or "ticket holder") by purchasing or using the tickets.
1. Ticket sale
1.1 The ticket sale of pro-log is directed exclusively to persons of legal age with a shipping address in Germany and is valid "while stocks last".
1.2 Advance ticket sales shall be made exclusively online via the website set up for this purpose by pro-log at "www.abenteuerallrad.de" (hereinafter "Website") and exclusively by way of payment via the payment service PayPal.
1.3 Ticket sales per order transaction and customer are limited to the number of 10 tickets. pro-log reserves the right to further limit the number of tickets per order transaction for certain lectures and special events.
1.4 Every customer ordering on behalf of a third party or on behalf of a third party hereby guarantees pro-log for the payment claims of pro-log arising from the order placed.
1.5 The offer for the conclusion of a contract is made by the customer as soon as he has clicked on the "buy now" field during the ordering process. The purchase contract is concluded when pro-log confirms the order by e-mail.
1.6 The prices stated on the website include the legal value added tax as well as further service and shipping costs if applicable and are displayed in the so-called shopping cart when the order is placed. The prices and costs stated at the time of the order are decisive.
1.7 Tickets for lectures and other chargeable special events are only valid in conjunction with a ticket for the ABENTEUER & ALLRAD trade fair valid on the day of the lecture event.
1.8 The customer assures that all data provided by him when ordering are true and complete, in particular also information regarding possible discounts. pro-log is entitled to check the conditions for discounts in a suitable manner and to refuse admission to ticket holders who do not fulfil the required characteristics for the discount or to demand subsequent payment. In the event of refusal of admission, any claims of the Ticket Holder - of whatever nature, in particular claims for reimbursement of the costs of purchasing the Ticket and claims for damages shall be excluded.
1.9 The total price of the order including all costs shall be payable in advance immediately after the order has been placed. Payment is only possible via the online payment service PayPal. In principle, the customer must be registered there or register first, legitimize with his access data and confirm the payment instruction to pro-log (exception: guest access, if applicable).
1.10. If no immediate payment should take place, pro-log is entitled to cancel the order without replacement, about which the customer will be informed by e-mail.
1.11. The tickets ordered by the customer in advance will be sent to the customer in time after payment has been made, at the latest one month before the event, by registered letter to the address in Germany indicated by the customer in the context of the order. Tickets will be sent by post at the customer's expense. The risk of dispatch lies with the customer, unless prolog or the third party commissioned by prolog has acted grossly negligently or intentionally in the dispatch, e.g. when selecting the transport company.
2. prohibition of commercial use
2.1 The Customer undertakes and expressly affirms to purchase and use the Tickets exclusively for private purposes.
2.2 The commercial resale of tickets is not permitted. pro-log can refuse to sell tickets to persons and cancel orders of the customer (unilateral right of withdrawal) who trade tickets on a commercial basis without pro-log's consent or make tickets available to such persons or who otherwise have reasonable suspicion that specific conditions established by pro-log and referred to in the context of the advance sale have been violated or are attempting to circumvent these (e.g.B. Violation of restrictions on the number of tickets per customer, violation of the document conditions, in particular prohibitions on resale, etc.). A justified suspicion is given in particular if the customer offers tickets via Internet resale platforms or if his purchasing behaviour suggests that the tickets are not purchased for private use. The declaration of cancellation/rescission may also be made conclusively by crediting the amounts paid. The aforementioned right of withdrawal is governed by §§ 346 et seq. of the German Civil Code (BGB). BGB shall apply to the exclusion of § 350 BGB.
3. return of tickets, cancellation
3.1 The provisions on revocation and right of return for distance selling contracts are not applicable to ticket purchases due to § 312g Para. 2 S. 1 No. 9 BGB (German Civil Code). This means that there is no two-week right of revocation and return.
3.2 Return of tickets and reimbursement of the ticket price are excluded, unless the event does not take place for reasons for which pro-log is responsible. In this case, reimbursement will only be made against return of the original ticket. In this case, the customer receives the ticket price paid by him credited to the specified PayPal account. In the event of loss, no compensation will be paid.
4. event and visit conditions
4.1 Any stay on the exhibition grounds shall be at your own risk.
4.2 By purchasing or using a ticket and entering the fair and exhibition grounds, the visitor declares that he accepts and observes the additional house and exhibition rules displayed at the venue.
4.3. pro-log exercises the householder's right on the entire exhibition grounds. When parking, the instructions of the security forces must be observed. The visitor parks his vehicle at his own risk. pro-log has the right to make a reference or ban to a place or house or to take other suitable measures within the scope of this house right in the event of a violation of the event and visit conditions as well as house and site regulations. In particular, visitors may be expelled from events or the exhibition grounds if they disturb them, harass other visitors or exhibitors or have in any other and substantial way or repeatedly violated the event and visitor conditions. Admission may be refused if there are reasonable grounds to suspect that the visitor will disturb the performance or harass other visitors or is obviously drunk. The ticket price will not be refunded in such cases. The right to refuse admission for any other important reason (against reimbursement of the ticket price) remains reserved.
4.4 Admission to lectures shall be 20 minutes prior to the start of the event, unless otherwise announced. Admission will not be possible after the start of the lecture. Free seating is available. There is no entitlement to a specific seat. If, exceptionally, seat tickets are sold, the visitor may only take the seat shown on his ticket. If he has taken a seat for which he does not have a valid ticket, pro-log can charge the difference or expel the visitor from the lecture event without the right to a refund of the ticket price. The ticket loses its validity when leaving the lecture rooms.
4.5 It is generally prohibited to bring glass containers, cans, pyrotechnic objects, torches as well as cutting and stabbing weapons, possible projectiles, other dangerous objects and alcoholic beverages. In the event of non-compliance, the visitor may be expelled from the event grounds. A security check will be carried out at the entrance. The security service is instructed to make body searches.
4.6 Sound, photo and video recordings for commercial purposes are generally not permitted. Misuse will be prosecuted. Exceptions will be announced by pro-log. By entering the event site, the visitor agrees to be filmed or photographed. Every visitor irrevocably consents to the free use of his picture and voice for all present and future media for photographs, live broadcasts, broadcasts and/or recordings of picture and/or sound made by pro-log or its agents in connection with the event.
4.7. pro-log reserves the right to postpone or cancel the event due to aggravation, endangerment or impairment of a significant nature due to unforeseeable and extraordinary circumstances such as war, civil unrest, epidemics, currency, trade policy or other sovereign measures, natural disasters, disasters, destruction of accommodation, strikes, lock-outs, operational disruptions or incidents of equal importance, regardless of whether these occur at pro-log or its service providers, the location and/or date of the event or to cancel the event, regardless of whether these occur at pro-log or its service providers.
4.8 The ticket loses its validity upon leaving the venue.
4.9. pro-log is not responsible for lost or stolen items, unless pro-log acted grossly negligent or intentionally. Objects of any kind found on the exhibition grounds must be handed in to the exhibition staff. The loss of objects must be reported to the trade fair personnel. Further handling of the lost property shall be governed by the statutory provisions (§§ 978 et seq. of the German Civil Code).
5. data protection
5.1. pro-log will observe the applicable data protection regulations valid in Germany. pro-log points out that the customer must provide his data or those represented by him online correctly so that the ticket order can be carried out correctly and become effective. The confidential treatment of this data is guaranteed within the framework of the statutory provisions.
5.2. pro-log collects, processes and uses the personal data provided, insofar as this is necessary within the scope of ordering and organizing the event, in accordance with the applicable data protection regulations. With his order, the customer gives his consent that the collected data may be stored by pro-log in machine-readable form and used, processed and published in accordance with the purpose of the organisation of the event. Personal data, as far as these are necessary for the processing of the order and/or for the fulfilment of the contractual services, are made available to third service providers to the extent necessary. pro-log is entitled to transmit the data to third parties commissioned by it with the execution of the event. Personal data will not be passed on to third parties for their advertising purposes.
6. limitation of liability
6.1 pro-log, its legal representatives and its vicarious agents are only liable for damages suffered by a visitor on the exhibition grounds and in the rooms there in the event of intent and gross negligence. This limitation of liability does not apply to claims arising from injury to life, limb or health.
6.2 In the event of a slightly negligent breach of a principal obligation or a secondary obligation, the breach of which endangers the achievement of the purpose of the contract or the fulfilment of which is essential for the proper execution of the contract and on the observance of which the visitor could rely (hereinafter referred to as "material secondary obligation"), pro-log's liability shall be limited to damages typical for the contract and foreseeable at the time of conclusion of the contract. pro-log shall not be liable for the slightly negligent breach of contractual secondary obligations which are not material secondary obligations.
7. final provisions
7.1 German law shall apply exclusively to the entire legal and contractual relationship to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
7.2 Place of performance and place of jurisdiction for merchants, legal entities under public law or special funds under public law is the court responsible for Bad Kissingen. This also applies if the customer does not have a general place of jurisdiction in Germany or if he moves his domicile or usual place of residence to a place outside Germany after conclusion of the contract or if his domicile or place of residence is not known at the time the action is filed. pro-log is, however, also entitled to sue at the customer's domicile.
